This Privacy Policy explains how the companies of the NEXON group collect, use, store, and protect personal data of website visitors, users of the NEXON Vision service, and customer representatives.
NEXON Vision is a SaaS service for managing digital signage screens, devices, playlists, schedules, and content.
The personal data controller depends on the customer's country of registration and the nature of interaction with the Service. The language of the website, interface, or communication does not determine the data controller.

2.1. With respect to the data of Customer representatives, contact persons, Account users, payment, and contractual data, NEXON typically acts as an independent data controller.
2.2. With respect to personal data that the Customer independently uploads, stores, or broadcasts via the Service within their Content, the Customer is typically the controller of such data, and NEXON acts as a data processor in accordance with the Data Processing Agreement (DPA) set out in Appendix 1.
2.3. The Customer is responsible for the existence of a lawful basis for uploading, storing, and broadcasting personal data of third parties through the Service.
If the Customer connects third-party services or integrations, we may process technical data, access tokens, account identifiers, and other information necessary for the operation of such integration.
If the Customer uses the Canva integration, design files, images, texts, layouts, links, and other materials necessary for creating designs, exporting, or importing content between Canva and the Service may be processed.

We use cookies and similar technologies for the operation of the website, session storage, security, analytics, and improvement of user experience. Non-essential cookies are used only with the relevant consent, where such consent is required by law.

Personal data, content, technical logs, device settings, playlists, and other Service data are stored and processed on servers in the European Union, in particular at the DigitalOcean data center in Frankfurt am Main, Germany.
This rule applies to all users and Customers of NEXON Vision regardless of their country of registration. Individual providers of technical, analytical, email, payment, or integration services may process a limited amount of data in other countries in accordance with this Policy.
We apply technical and organizational security measures, including HTTPS, access control, backup, action logging, restriction of employee access, and other measures described in Appendix 2.
For the operation of the Service, we may engage third-party providers who process data only to the extent necessary for providing the relevant services.

Where NEXON acts as a data processor, the current list of subprocessors may be set out in the DPA or provided to the Customer upon request.
If personal data is transferred outside the European Economic Area, we apply appropriate legal protection mechanisms, in particular EU Standard Contractual Clauses (SCC), adequacy decisions, or other mechanisms permitted by law.
If the Customer uses integrations with Google services, the Service processes Google data only to provide the relevant function activated by the Customer.
We do not use data obtained through Google APIs for advertising, do not sell such data, and do not transfer it to third parties, except in cases necessary for the operation of the integration, security, or compliance with law.
If the Customer uses the Canva integration, individual data and files may be transferred to Canva or received from Canva for creating designs, editing layouts, exporting images, videos, or other materials to the Service.
The use of Canva may be governed by separate Canva terms and policies. The Customer is independently responsible for compliance with Canva's terms if they use the relevant integration or their own Canva account.
We may send existing customers information about important changes in the Service, updates, technical notifications, and commercial offers regarding similar services, where permitted by law.
The user can opt out of marketing communications at any time by writing to [email protected] or using the unsubscribe link if it is in the email.
Active Account data is stored during the period of use of the Service.
After the end of the paid period and the absence of payment for 90 calendar days, we may permanently delete the Account, Content, settings, playlists, schedules, and other data.
Accounting, tax, and contractual documents may be stored longer if necessary for compliance with legislative requirements, protection of rights, or consideration of disputes.
Backups may be stored for a limited technical period and are deleted in accordance with internal backup procedures.

If you are located in the EU or your data is processed by NEXON Systems Sp. z o.o., you have the right to contact the Polish personal data protection supervisory authority — Prezes Urzędu Ochrony Danych Osobowych or another competent authority in your country of residence.
If your data is processed by NEXON Ukraine LLC, you can contact the competent authority of Ukraine in the field of personal data protection, if such authority has powers regarding your matter.
We apply reasonable technical and organizational measures to protect personal data from unauthorized access, loss, alteration, destruction, or disclosure. At the same time, no system can guarantee absolute security.
We may periodically update this Policy. The new version takes effect from the moment of publication on the website, unless otherwise specified in the text of the update.
This Data Processing Agreement is part of the agreement between the Customer and the relevant NEXON Provider, where NEXON processes personal data on behalf of the Customer.
The Customer is the personal data controller. The relevant NEXON Provider is the processor of personal data within the scope of providing the Service.
The subject of processing is personal data that the Customer uploads, stores, or processes through NEXON Vision. The duration of processing corresponds to the term of the agreement and an additional period of up to 90 calendar days after the end of the paid period, unless the data is deleted earlier at the Customer's request or in accordance with the law.
Processing includes hosting, storage, transmission, backup, technical support, ensuring security, error diagnosis, and other operations necessary for providing the Service.
The main place of processing and storage of personal data is the European Union, the DigitalOcean data center in Frankfurt am Main, Germany.
Special categories of personal data are not intended for processing in the Service. The Customer must not upload such data unless this has been separately agreed with NEXON in writing.

The Customer grants NEXON a general authorization to engage subprocessors for providing the Service. NEXON ensures that subprocessors have data protection obligations that materially correspond to this DPA.

If a subprocessor or technical provider processes data outside the EEA, NEXON applies appropriate legal mechanisms, in particular SCCs or other mechanisms permitted by law.
Upon written request from the Customer, NEXON may provide reasonable information about technical and organizational measures. Audits must not violate the security, confidentiality, rights of other customers, or operation of the Service.
